Safe Harbor Compliance Policy
Craig D. Ball, P.C.

The policy and practice of Craig D. Ball, P.C. with respect to personal information of individuals residing within the Member States of the European Union (“EU Personal Information”) is to recognize the privacy of such personal information as a fundamental human right and to protect such personal information in a manner consistent with the seven Safe Harbor principles addressing Notice, Choice, Onward Transfer, Access, Security, Data Integrity and Enforcement.

Notice
As required, Craig D. Ball, P.C. will notify individuals residing within the EU Member States about the purposes for which Craig D. Ball, P.C. collects and uses information about them.  Such individuals can contact Craig Ball, President of Craig D. Ball, P.C., with any inquiries or complaints or to secure information about the types of third parties to which Craig D. Ball, P.C. discloses EU Personal Information and the choices and means offered for limiting its use and disclosure.

Choice
Craig D. Ball, P.C. offers notify individuals residing within the EU Member States the opportunity to choose whether their personal information will be disclosed to a third party or used for a purpose incompatible with the purpose for which it was originally collected or subsequently authorized by the individual. For sensitive EU Personal Information, affirmative or explicit (opt in) choice will be given if the information is to be disclosed to a third party or used for a purpose other than its original purpose or the purpose authorized subsequently by the individual.

Onward Transfer (Transfers to Third Parties)
To disclose EU Personal Information to a third party, Craig D. Ball, P.C. applies the Notice and Choice principles.  If Craig D. Ball, P.C. transfers EU Personal Information to a third party agent, it will ascertain that the third party subscribes to the Safe Harbor principles or is subject to the Directive on Data Protection or otherwise adheres to means and methods to insure privacy of EU Personal Information that are more stringent than Safe Harbor or DDP.  Alternatively, Craig D. Ball, P.C. may enter into a written agreement with such third party requiring that the third party provide at least the same level of privacy protection as is required by the Safe Harbor principles.

Access
Craig D. Ball, P.C. affords individuals residing within the Member States of the European Union access to EU Personal Information about them it holds and also affords them the ability to correct, amend, or delete that information where it is inaccurate, excepting circumstances where the burden or expense of providing this access is disproportionate to the risks to the individual's privacy in the case in question, or where the rights of persons other than the individual would be violated.

Security
Craig D. Ball, P.C. takes reasonable precautions to protect EU Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction.

Data Integrity
Craig D. Ball, P.C. acts to insure that EU Personal Information it collects and processes is relevant for the purposes for which it is used and takes reasonable steps to ensure that such data is reliable for its intended use, accurate, complete, and current.

Enforcement
In order to ensure compliance with the Safe Harbor principles and permit a readily available and affordable independent recourse mechanism, Craig D. Ball, P.C. and its principal, Craig Ball, are subject to regulation and discipline coupled with sufficiently rigorous sanctions as warranted to ensure compliance. Persons wishing to present complaints or disputes may direct them to the State Bar of Texas, Office of Chief Disciplinary Counsel, La Costa Center, 6300 La Calma Dr., Ste. 300, Austin, Texas 78752, TEL: (512) 453-5535, Toll Free: (877) 953-5535, Fax: (512) 453-6667. Alternatively, complaints may be presented to the Supreme Court of Texas or the United States District Court for the Western District of Texas, Austin Division. Craig D. Ball, P.C. also agrees to be subject to oversight, investigation and discipline by the U.S. Federal Trade Commission for complaints or inquiries concerning Safe Harbor compliance with respect to the handling of EU Personal Information.

Note: The policies and practices described herein apply only to EU Personal Information subject to the Safe Harbor framework. Practices and policies meeting less rigorous privacy standards and practices may apply to information not subject to the Safe Harbor framework, including personal information from sources, citizens, companies and law firms based or residing within the United States or non-EU Member States.
